Terms and Conditions

Article 1 - General

1. All Boat Charters offers boat tours and water sports activities in and around Curaçao.

2. All Boat Charters reserves the right to change routes, start and end locations when required due to weather conditions, shallows, or other legitimate reasons. Passengers will be informed in a timely manner.

3. The captain always has final responsibility, and safety comes first.

4. By booking a trip, renting a boat, or participating in a water sports activity, you agree to the general terms and conditions of All Boat Charters.

Article 2 - Bookings and Day Trips

1. Bookings for day trips can be made per person or per group via our website or agents.

2. Passengers for a day trip must be present at the agreed departure location at least 30 minutes before the departure time.

3. Subleasing the boat to a third party is not allowed.

4. In case of late arrival for a booked day trip, the right to board is forfeited without refund of the paid amount.

Article 3 - Boat Rental and Private Tours

1. All Boat Charters offers boat rental for private tours and group tours with different vessels. Your booking confirmation clearly indicates which boat is involved.

2. Boat rental through All Boat Charters always includes the crew, the number depending on the vessel and group size (skipper and crew).

Article 4 - Waiting Times and Delays

1. There are no waiting times for regular trips/group tours. Passengers who arrive late lose their right to board without refund.

Article 5 - Transfers

1. Transfers are available with our official transfer partner and can be booked in advance via our website or agents.

2. After completing the booking, you will receive a confirmation with pickup details. Be ready at the agreed location on time.

3. If the driver does not appear on time, please inform All Boat Charters as soon as possible.

Article 6 - Execution of the Booking

1. Valid reasons for cancellation include weather conditions and unexpected vessel maintenance that jeopardizes passenger safety.

2. In case of misconduct, caused by alcohol consumption or drug use, the trip may be interrupted or terminated by the skipper. The payment obligation remains.

3. Possession and trafficking of drugs are not allowed aboard our vessels.

Article 7 - Check-in and Departure Times

1. You must be present 30 minutes before departure for check-in. Boarding closes 15 minutes before departure.

2. Departure times are up-to-date on the relevant tour information pages. All Boat Charters is not liable for conflicting information.

Article 8 - Liability of Trips

1. All Boat Charters is not liable for damage to personal property or injury to passengers.

2. Passengers enter piers and boats entirely at their own risk.

Article 9 - Passenger Liability

1. Passengers are liable for damage to property of All Boat Charters or third parties.

2. All activities organized by All Boat Charters are at the passengers’ own risk.

Article 10 - General Liability

1. All Boat Charters is not liable for personal injury or damage of any kind, except in case of intent or gross negligence of All Boat Charters. Liability is limited to the amount of the boat rental.

2. Children are the responsibility of their parents. Life jackets are available upon request.

3. In case of force majeure, there is no right to refund or compensation.

Article 11 - Payment, Cancellation, and Changes/Weather Conditions

1. Bookings are confirmed after payment.

2. Cancellation is possible via phone, WhatsApp, and email.

3. Payment can be made online or in cash at the office.

4. Specific refund conditions apply for cancellation of a day trip to Klein Curaçao.

5. In case of extreme weather conditions, a new date will be arranged within 60 days.

Article 12 - Final Provisions

1. Passengers must follow instructions from the crew at all times.

2. Wearing footwear is not allowed.

3. Passengers are expected to respect the environment and properly dispose of waste.

Article 13 - Complaints

1. Complaints should be reported to All Boat Charters as soon as possible for a suitable solution.

2. Complaints not resolved on-site must be submitted by email to All Boat Charters within 7 days after the end of the activity.

Article 14 - Personal Data

1. Personal data is only used for booking purposes and is not kept longer than necessary.

2. The customer gives All Boat Charters irrevocable consent for the use and storage of personal data.

Article 15 - Cancellation and Payment Policy of All Boat Charters

1. Payment Policy:
For regular tours and private charters, at least 50% of the total amount due must be paid in advance. The remaining amount can be paid upon arrival before departure. Last-minute additions must be fully paid upon request.
1. Cancellation Policy:
All cancellation requests must be submitted via email and confirmed by info@allboatcharters.com.
1. For regular tours:
– Cancellation 48 hours or more prior to the tour date will result in a full refund or customers can change the tour date free of charge.
– Cancellation between 24 and 48 hours prior to the tour date will result in a 50% refund of the paid amount, or customers can change the tour date with a rebooking fee of 30%.
– Cancellations less than 24 hours prior to the tour date are not eligible for a refund.
1. For charters and customized tours:
– Cancellation 15 days or more prior to the tour date will result in a full refund, or customers can change the tour date free of charge.
By booking a trip or participating in a water sports activity with All Boat Charters, you agree to these general terms and conditions.
